All prices displayed on CitizenEarth platforms are listed in the applicable currency specified at the time of purchase and are subject to change without prior notice.

Unless expressly stated otherwise, prices may exclude applicable taxes, duties, levies, customs charges (in case of International shipments), shipping fees, transaction fees, and other governmental or regulatory charges, which may be added at checkout or collected by relevant authorities upon delivery, depending on the destination and applicable laws.

In case of International shipments, Customers are solely responsible for any customs duties, import taxes, clearance fees, or similar charges imposed by local authorities in the destination jurisdiction.

Payment must be successfully authorised, verified, and received in full before an order is accepted, processed, or dispatched. CitizenEarth reserves the right to refuse, cancel, suspend, or limit any order or transaction at its sole discretion, including where:

Payment cannot be authorised or verified;
Pricing, product, or technical errors have occurred;
Fraudulent, unlawful, or suspicious activity is suspected; or
The transaction otherwise violates these Terms or applicable law.

CitizenEarth shall not be liable for losses arising from pricing inaccuracies, payment processing failures, banking interruptions, currency fluctuations, or third-party payment service provider issues. CitizenEarth may request additional information or documentation to verify the ownership of a payment method, prevent fraud, comply with legal obligations, or maintain platform security.

7. PRODUCT INFORMATION

We make every reasonable effort to accurately display and describe our products.

However:

Colours may vary across screens and devices.
Images are representative only.
Measurements may vary slightly.
Product appearance may differ due to natural materials, handcrafted techniques, artisan processes, recycled materials, upcycled materials, or natural dyeing methods.

Many CitizenEarth products are intentionally crafted using artisanal, hand-finished, natural, recycled, regenerative, or repurposed materials.

Minor variations in texture, stitching, weave, colour, print placement, grain, finish, or appearance are natural characteristics and shall not be considered defects.

CitizenEarth does not guarantee that website content, descriptions, images, specifications, or pricing are error-free, complete, current, or entirely accurate.

8. SIZE AND FIT

Size charts are provided as guides only.

Actual fit may vary depending upon:

Fabric characteristics.
Garment construction.
Product style.
Individual body proportions.

Customers are encouraged to carefully review sizing information before purchasing.

CitizenEarth shall not be responsible for dissatisfaction arising solely from sizing preferences.

9. SHIPPING AND DELIVERY

Shipping timelines displayed on the website are estimates only.

Delivery dates are not guaranteed.

CitizenEarth shall not be responsible for delays caused by:

Customs processing.
Weather conditions.
Logistics disruptions.
Government restrictions.
Force majeure events.
Carrier-related delays.

Risk of loss and title to products pass to the customer upon delivery to the shipping address provided.

10. RETURNS, EXCHANGES, AND REFUNDS

Returns, exchanges, and refunds are governed by the CitizenEarth Returns, Exchange and Refund Policy available on our website.

CitizenEarth reserves the right to deny returns or exchanges that do not satisfy the conditions outlined in that policy.

Repeated misuse of return or exchange privileges may result in account restrictions or refusal of future orders.

12. USER-GENERATED CONTENT

You may voluntarily submit photographs, videos, testimonials, reviews, stories, comments, suggestions, designs, creative concepts, event submissions, community contributions, or other content ("User Content").

By submitting User Content, you grant CitizenEarth a worldwide, perpetual, irrevocable, royalty-free, transferable, sublicensable licence to:

Reproduce
Adapt
Publish
Translate
Modify
Distribute
Display
Create derivative works from

such content for editorial, educational, marketing, community, promotional, commercial, or other lawful purposes.

You warrant that:

You own or control the rights to the submitted content.
Submission does not violate any law.
Submission does not infringe third-party rights.

CitizenEarth may remove User Content at its sole discretion.

13. INTELLECTUAL PROPERTY

All content available through CitizenEarth, including but not limited to:

Brand names
Logos
Trademarks
Artwork
Product designs
Prints
Films
Photography
Graphics
Text
Community materials
Educational content
Experiences
Audio content
Visual content

is owned by or licensed to CitizenEarth and protected under applicable intellectual property laws.

No part of the Services may be copied, reproduced, distributed, modified, published, sold, licensed, or otherwise exploited without prior written permission.

Nothing contained in these Terms grants any ownership rights to users.

14. THIRD-PARTY LINKS

Our website may contain links to third-party websites or services.

CitizenEarth does not control, endorse, or assume responsibility for:

Third-party content.
Third-party products.
Third-party privacy practices.

Accessing third-party services is done entirely at your own risk.

15. FORCE MAJEURE

CitizenEarth shall not be liable for any delay, interruption, or failure in performance resulting from events beyond our reasonable control, including but not limited to natural disasters, floods, earthquakes, fires, epidemics, pandemics, government actions, labour disputes, transportation disruptions, war, terrorism, internet outages, utility failures, supply chain shortages, cyber incidents, or any other force majeure event.

CitizenEarth shall not be liable for any delay, interruption, or failure in performance resulting from events beyond our reasonable control, including but not limited to:

Natural disasters.
Floods.
Earthquakes.
Fires.
Epidemics.
Pandemics.
Government actions.
Labour disputes.
Transportation disruptions.
War.
Terrorism.
Internet outages.
Supply chain shortages.
Utility failures.
Cybersecurity incidents.

Where such circumstances continue for more than ninety (90) consecutive days, either party may terminate the affected order or service by written notice. Amounts due for products already delivered remain payable.

16. DISCLAIMER OF WARRANTIES

The Services and products are provided on an "as is" and "as available" basis.

To the fullest extent permitted by law, CitizenEarth disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of:

Merchantability.
Fitness for a particular purpose.
Non-infringement.
Accuracy.
Availability.
Reliability.

CitizenEarth does not guarantee uninterrupted access to the Services.F

17. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, CitizenEarth, its directors, officers, employees, partners, affiliates, contractors, agents, licensors, and suppliers shall not be liable for:

Indirect damages.
Consequential damages.
Incidental damages.
Special damages.
Punitive damages.
Loss of profits.
Loss of goodwill.
Loss of data.
Business interruption.

CitizenEarth's total liability arising out of any claim shall not exceed the amount paid by the customer for the specific product or service giving rise to the claim.

18. INDEMNIFICATION

You shall defend, indemnify and hold harmless CitizenEarth its owners, affiliates, subsidiaries, group companies, partners (as applicable), and their respective officers, directors, agents, and employees (" Indemnified Parties"), from and against any claim, demand, damages, obligations, penalty, losses or actions (including reasonable attorneys' fees) made by any third party against the Indemnified Parties or imposed against the Indemnified Parties, due to or arising out of your or relative's: (a) breach of these Terms, the Privacy Policy and/or any other policies; or (b) violation of any applicable law, rules, regulations; or (c) violation of the rights (including infringement of intellectual property rights) of a third party or CitizenEarth; or (d) unauthorized, improper, illegal or wrongful use of your CitizenEarth account (including by you or by any person, including a third party, whether or not authorized or permitted by you). This indemnification obligation will survive the expiry or termination of these Terms and/or your use of the Service.

19. SUSPENSION & TERMINATION

CitizenEarth reserves the right, at its sole discretion and without prior notice, to suspend, restrict, disable, or terminate a user's access to any part of the Services, including accounts, memberships, community participation, events, programs, or other CitizenEarth offerings, where CitizenEarth reasonably believes that:

These Terms have been violated;
Fraudulent, unlawful, abusive, or harmful conduct has occurred;
The security, integrity, reputation, or operation of CitizenEarth may be adversely affected; or
Such action is otherwise necessary to protect CitizenEarth, its users, partners, or the broader community.

CitizenEarth may also discontinue, modify, or withdraw any Service, feature, program, product, or offering at any time without liability, subject to applicable law.

Termination or suspension shall not affect any rights, remedies, obligations, liabilities, disclaimers, indemnities, or provisions intended to survive termination, all of which shall remain in full force and effect.

CitizenEarth reserves all rights and remedies available under applicable law in connection with any breach of these Terms.

20. SEVERABILITY

If any provision of these Terms is held invalid, void, or unenforceable, then that provision shall be considered severable from the remaining provisions, and the remaining provisions shall be given full force and effect.

21. GOVERNING LAW AND JURISDICTION

These Terms shall be governed, interpreted, and construed in accordance with the laws of India, without regard to the conflict of law provisions and for resolution of any dispute arising out of your use of the Services or in relation to these Terms. Notwithstanding the foregoing, you agree that (i) CitizenEarth has the right to bring any proceedings before any court/forum of competent jurisdiction and you irrevocably submit to the jurisdiction of such courts or forum; and (ii) any proceeding brought by you shall be exclusively before the courts in New Delhi, India.
